Welcome to ClassHub! These Terms and Conditions ("Terms") govern your use of the ClassHub website ClassHub.co.nz and services (collectively, the "Platform"), operated by ClassHub.
By accessing or using our Platform, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Platform.
These Terms should be read in conjunction with our Privacy Policy.
1. Definitions
"Platform" refers to the ClassHub website, applications, and services.
"User" refers to any individual who browses the Platform, searches for, or engages with Providers or their services.
"Provider" refers to any individual teacher, organisation, or service provider who registers on the Platform to offer classes, workshops, or services.
"Content" means any text, images, video, audio, documents (such as PDF qualification files), or other material that you post, upload, or otherwise make available on the Platform.
2. Platform Services
ClassHub provides an online platform to connect Users with Providers offering various classes, workshops, and services based on interests and location.
ClassHub's role is solely to facilitate these connections. We are not an employer of Providers, nor are we an education institution. We do not directly offer classes or services ourselves.
We may, at our discretion, approve, reject, or remove any Provider or class listing from the Platform.
3. Account Registration and Responsibilities
To access certain features, you may need to register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account.
Users must be at least 13 years old to create an account. If you are registering on behalf of a minor (e.g., as a parent adding a family member), you are responsible for their use of the Platform under your account.
4. Obligations for Service Providers and Teachers ("Providers")
Accurate Information: You agree to provide accurate, complete, and truthful information about yourself, your organisation, your qualifications, and the classes/services you offer. You are solely responsible for the accuracy of your listings.
Qualifications: If you upload qualifications, you warrant that they are genuine and accurately represent your credentials. ClassHub does not independently verify all qualifications but reserves the right to request verification.
Conduct: You agree to conduct yourself professionally and respectfully in all interactions facilitated by the Platform.
Service Delivery: You are solely responsible for the quality, safety, legality, and delivery of the services or classes you offer.
Eligibility: Service Providers must be based in New Zealand and offer services within New Zealand. We reserve the right to remove listings or suspend accounts that do not meet this requirement.
Content: You retain ownership of the Content you submit. By posting Content, you grant ClassHub a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform the Content in connection with the Platform and ClassHub's business.
Compliance with Laws: You agree to comply with all applicable New Zealand laws and regulations regarding your services and conduct.
5. Obligations for Users
Lawful Use: You agree to use the Platform only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Platform.
Respectful Interaction: You agree to interact respectfully with Providers and other Users.
Reviews: If you leave reviews, they must be truthful, based on your own experience, and not contain offensive, defamatory, or misleading content. ClassHub reserves the right to remove reviews that violate these terms.
No Guarantees: You acknowledge that ClassHub does not endorse, guarantee, or vet every Provider or their services. From time to time, ClassHub may highlight or feature certain Providers or services based on various criteria. Such highlighting does not constitute a guarantee of quality or suitability beyond the information provided by the Provider themselves, and Users should still exercise their own due diligence.
6. Content on the Platform
ClassHub does not pre-screen all Content but reserves the right (but not the obligation) in our sole discretion to refuse or remove any Content that is available via the Platform, particularly if it violates these Terms or is otherwise objectionable.
We are not responsible for the accuracy, completeness, or usefulness of any Content provided by Users or Providers. Any reliance you place on such information is strictly at your own risk.
While we make reasonable efforts to keep information accurate and up to date, details may change. Listings may be created or updated by Providers or by ClassHub on their behalf. Providers are responsible for the accuracy of their listings. We also review and update information where possible. We encourage Users to confirm important details directly with the Provider.
7. Fees and Payment
Currently, access to and use of basic features of ClassHub may be free. We reserve the right to introduce fees for certain features or services in the future. Any such changes will be communicated to you in advance.
8. Intellectual Property
The Platform and its original content (excluding Content provided by Users and Providers), features, and functionality are and will remain the exclusive property of ClassHub and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
9. Disclaimers
The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. ClassHub makes no warranties, expressed or implied, regarding the operation of the Platform or the information, content, materials, or products included on the Platform.
ClassHub does not warrant that the Platform will be uninterrupted, secure, or error-free.
ClassHub is a venue for connecting Users and Providers. We are not a party to any agreement or transaction between Users and Providers. We expressly disclaim any liability for any disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to conduct of Users or Providers, or the quality, safety, or legality of the services offered.
We do not endorse or recommend any specific Provider or service. Any decisions to engage with a Provider are made at your own risk.
10. Limitation of Liability
To the fullest extent permitted by applicable New Zealand law, in no event shall ClassHub, nor its directors,
employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special,
consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or
other intangible losses, resulting from (i) your access to or use of or inability to access or use the Platform;
(ii) any conduct or content of any third party on the Platform;
(iii) any content obtained from the Platform; and (iv) unauthorised access, use, or alteration of your
transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal
theory, whether or not we have been informed of the possibility of such damage.
Our maximum aggregate liability to you for any claims arising out of or relating to these Terms or your use of
the Platform shall be limited to NZD $100.
11. Indemnification
You agree to defend, indemnify, and hold harmless ClassHub and its licensee and licensors, and their employees,
contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses,
liabilities, costs or debt, and expenses (including but not limited to legal fees), resulting from or arising
out of a) your use and access of the Platform, by you or any person using your account and password;
b) a breach of these Terms, or
c) Content posted on the Platform by you.
12. Termination
We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or
liability, under our sole discretion, for any reason whatsoever and without limitation, including but not
limited to a breach of the Terms.
If you wish to terminate your account, you may simply discontinue using the Platform or contact us to request
account deletion.
13. Dispute Resolution
Between Users and Providers: ClassHub is not responsible for resolving disputes between Users and Providers. We encourage you to communicate directly to resolve any issues.
With ClassHub: We encourage you to contact us first if you have a dispute with ClassHub. We will try to resolve disputes informally.
14. Governing Law
These Terms shall be governed and construed in accordance with the laws of New Zealand, without regard to its conflict of law provisions.
15. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time.
If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect
(e.g., by posting on the Platform or via email). What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.
